HY Sweat Studio operates through its physical studios and its digital channels.

By using the Website, creating an account, making a booking or purchasing a service, the User declares that they have read and accepted these Terms.

The Terms applicable to a purchase are those available at the time of the purchase itself.

Any specific conditions indicated on the page of a particular service, package, membership, promotion or event form an integral part of these Terms.

HY Sweat Studio offers, among others:

• individual and group classes
• class packages
• memberships
• private classes
• events and workshops
• Gift Cards
• any further services indicated on the Website or on the booking platform

The features, prices, duration, validity and specific conditions of each service are indicated at the time of purchase.

Creating an account may be required to purchase or book certain services.

HY Sweat Studio uses Bsport to manage bookings, accounts, packages and memberships.

The User is responsible for the accuracy of the information provided and for the confidentiality of their credentials.

The account is personal and must not be used by third parties without authorisation.

HY Sweat Studio reserves the right to suspend or restrict an account in the event of fraudulent use, abuse of the services, breach of these Terms or of the Studio's rules, as well as when reasonably necessary for security reasons.

The processing of personal data is governed by HY Sweat Studio's Privacy Policy.

Applicable prices are those indicated on the Website, on the booking platform or communicated to the customer at the time of purchase.

Unless otherwise indicated, prices are expressed in euros and include applicable taxes.

Payments may be made through the methods made available by HY Sweat Studio, which may include:

• credit or debit card
• online payment via Stripe and/or Bsport
• bank transfer
• cash at the Studio, within the limits permitted by law

HY Sweat Studio reserves the right to change the prices of its services for future purchases.

Price changes do not affect services already purchased, except as may be provided by the specific conditions of a membership or a continuous service and in accordance with applicable law.

Packages, memberships and credits are subject to the duration and conditions indicated at the time of purchase.

Unless otherwise indicated, they are personal and non-transferable and may only be used by the account holder.

Credits must be used within their period of validity.

Once that period has elapsed, unused credits expire, subject to any extensions expressly granted by HY Sweat Studio or as provided by law.

Any suspensions, extensions or special conditions are governed by the conditions of the specific product purchased.

Any promotional offers, introductory packages or promotions dedicated to new customers are subject to the conditions specifically indicated at the time of purchase.

HY Sweat Studio may set eligibility requirements, validity periods and usage limits specific to each promotion.

Unless otherwise indicated, promotions cannot be combined.

Gift Cards purchased from HY Sweat Studio are subject to the conditions and validity period indicated at the time of purchase.

Unless otherwise indicated, Gift Cards are personal and cannot be converted into cash.

The conditions relating to the activation and use of the credits associated with the Gift Card are indicated in the relevant offer.

In the event of a conflict between these Terms and specific conditions clearly communicated at the time of purchase of the Gift Card, the latter shall apply, within the limits permitted by law.

Participation in classes is subject to availability.

Bookings may be made through Bsport or through any other channels made available by HY Sweat Studio.

A booking is considered confirmed once it has been correctly recorded in the system.

The User is responsible for checking the date, time, Studio and type of the class booked.

A booking may be cancelled without penalty up to 12 hours before the class start time, unless different conditions are clearly indicated for events, workshops, private classes or specific initiatives.

If a cancellation is made within the required timeframe, the credit for the class is normally returned to the account and retains the validity provided by the package or service with which it was purchased.

The return of the credit does not amount to a monetary refund of the original purchase.

If a cancellation is made less than 12 hours before the start of the class ("Late Cancellation"), the credit for the booking is considered used and is not automatically returned.

If the User does not attend a booked class without having cancelled it within the required timeframe ("No-Show"), the relevant credit is considered used.

For memberships or Unlimited plans, HY Sweat Studio may provide for specific measures in the event of repeated Late Cancellations or No-Shows, provided that such conditions are communicated to the User.

Such measures are intended to ensure the availability of spots and proper access to classes for all customers.

When a class is full, the User may, where available, join the waiting list.

Should a spot become available, the User may be added to the class in accordance with the procedures provided by the booking system.

It is the User's responsibility to check the status of their bookings and any notifications received.

The normal cancellation conditions apply to bookings confirmed through the waiting list, in accordance with the procedures communicated through the booking system.

To ensure classes run properly and not disrupt the practice of other participants, Users are advised to arrive with sufficient time in advance.

Entry is not permitted more than 5 minutes after the class start time.

In the event of arrival beyond this limit, HY Sweat Studio may refuse access to the class.

The relevant credit may be considered used in accordance with the rules applicable to No-Shows or Late Cancellations.

HY Sweat Studio reserves the right to change, where necessary:

• class times
• instructors
• type of class
• assigned room
• schedule
• availability of services

The replacement of an instructor does not, in itself, constitute grounds for a refund of a class.

Should a class be cancelled directly by HY Sweat Studio, the relevant credit will be returned to the User or an equivalent solution will be offered.

HY Sweat Studio may schedule periods of closure for holidays, vacation, maintenance, works, organisational needs or other requirements.

Scheduled closures are communicated through the channels considered appropriate.

In the event of extraordinary events or circumstances beyond HY Sweat Studio's reasonable control, changes, suspensions or cancellations of services may occur.

HY Sweat Studio will adopt, where reasonably possible, appropriate measures to limit inconvenience to Users and to manage any services already purchased in accordance with the applicable conditions and the law.

Users are required to behave respectfully towards instructors, staff and other participants.

They must also comply with staff instructions and the Studio's safety rules.

HY Sweat Studio reserves the right to remove or refuse access to individuals whose behaviour is dangerous, offensive, seriously disrespectful or such as to jeopardise safety or the proper conduct of activities.

The activities offered by HY Sweat Studio involve physical exercise and, in some cases, take place in heated environments.

Each participant is responsible for assessing their own ability to carry out the chosen activity and for using the services responsibly.

Users are advised to follow the instructors' guidance and to stop the activity should they feel unwell or believe they are unable to continue safely.

In case of any doubts regarding their fitness to engage in physical activity or exercise in a heated environment, it is advisable to consult a qualified healthcare professional beforehand.

HY Sweat Studio does not request information regarding the User's health status through the normal registration process.

Users are responsible for their personal belongings brought inside the Studios.

HY Sweat Studio advises against leaving valuables unattended.

To the extent permitted by law, HY Sweat Studio is not liable for the loss, theft or damage of personal belongings where the event is not attributable to the company.

When the User makes an online purchase as a consumer, the mandatory provisions of the Italian Consumer Code regarding distance contracts and the right of withdrawal apply.

The right of withdrawal may be excluded in the cases expressly provided for by law.

In particular, pursuant to Article 59 of Legislative Decree 206/2005, the right of withdrawal may not apply to certain services relating to leisure activities when the contract provides for a specific date or period of performance.

Any exclusion of the right of withdrawal is therefore assessed in relation to the nature of the service purchased.

Nothing in these Terms limits the mandatory rights granted to consumers by law.

Except as provided by applicable law or by the specific conditions of the service purchased, purchases made from HY Sweat Studio are not normally refundable.

The User's personal inability to make use of a service, class, package or membership does not automatically entitle them to a refund.

The rights granted to consumers by applicable law remain unaffected.

Any refunds or credits granted at HY Sweat Studio's discretion in specific cases do not constitute a permanent amendment to these Terms nor a right to the same exception being granted in the future.

HY Sweat Studio undertakes to provide its services professionally and to adopt the measures reasonably necessary to ensure the proper conduct of its activities.

The User must use the facilities, equipment and services appropriately and comply with the instructions provided by staff and instructors.

HY Sweat Studio shall not be liable for damage arising from improper use of the facilities or services, failure to comply with the instructions provided, or User conduct in breach of these Terms, except where liability is attributable to HY Sweat Studio under the law.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

HY Sweat Studio seeks to ensure the availability and proper functioning of its Website and the digital systems used.

However, the Website or third-party services used for bookings and payments may be temporarily unavailable due to maintenance, updates, technical issues or circumstances not directly under HY Sweat Studio's control.

HY Sweat Studio does not guarantee that the Website will be available without interruption at all times.

Unless otherwise indicated, the Website and its content, including:

• trademarks
• logos
• text
• photographs
• videos
• graphics
• design
• promotional materials
• original content

are owned by HY Sweat Studio or used under a valid authorisation.

Such content may not be reproduced, distributed, modified or used for commercial purposes without prior written authorisation, except as permitted by law.

Users' personal data is processed as described in HY Sweat Studio's Privacy Policy, available on the Website.

The use of cookies and similar technologies is governed by the information and preference management tools available on the Website.

HY Sweat Studio may periodically update these Terms to reflect changes in applicable law, its organisation or its services.

The updated version will be published on the Website, indicating the date of the last update.

Changes will not affect rights already acquired by Users and will be applied in accordance with applicable law.

These Terms are governed by Italian law.

Any dispute shall be subject to the jurisdiction identified in accordance with applicable law.

Where the User acts as a consumer, the jurisdiction of the court of the consumer's place of residence or domicile shall apply in the cases provided for by applicable law.
